1. Legal information and acceptance
These terms and conditions regulate the use of the services of the Website (hereinafter the "Website") that REAL MADRID CF (hereinafter "REAL MADRID") has made available to Internet users.
REAL MADRID, with address at Avenida de Concha Espina, nº 1, Madrid, Spain and with Tax ID (C.I.F) G-28034718, is registered in the Registry of Sports Entities of the Community of Madrid, under number 849 by Resolution of 17 November 1992.
Access to the Website is free of charge, except for the cost of connection through the telecommunications network supplied by the service provider contracted by the users.
Access and use of the Website implies the user status of the Website (hereinafter, the "User") and implies acceptance of all the conditions included in this Legal Notice, as well as any modifications thereto. The Website service is provided for a duration that is limited to the time at which the User connects to the Website or to any of the services provided through the Website. Therefore, the User must read this Legal Notice carefully each time he/she intends to use the Website, as the Website and the conditions for its use contained in this Legal Notice may undergo modifications.
Some services of the Website accessible to Users or exclusive to REAL MADRID clients may be subject to specific conditions, regulations or instructions that, where appropriate, replace, complete and/or modify this Legal Notice and must be accepted by the User before the provision of the corresponding service.
The Website is mainly addressed to Users residing in Spain. REAL MADRID cannot guarantee that the Website fully or partially complies with the legislation of other countries. If the User resides, or currently lives, in any other place and decides to access and/or use this Website, he/she does so at his/her own responsibility and risk and must ensure that such access and/or use complies with the applicable local legislation, REAL MADRID assumes no liability that may arise from such access.
2. Intellectual and industrial property
All content and/or any other component of the Website, which is understood to include, but not limited to, text, photographs, graphics, images, icons, technology, software, links and other audiovisual or audio content, as well as its graphic design and source codes (hereinafter, the 'Content'), is the intellectual property of REAL MADRID or third parties, and the exploitation rights recognised by current legislation on intellectual property may not be considered licensed to the User unless it is strictly necessary for the use of the Website.
All trademarks, trade names or logos are the property of REAL MADRID or third parties, and access to the Website may not be considered as granting any right to said trademarks, trade names and/or logos.
By virtue of the provisions of Royal Legislative Decree 1/1996, of 12 April, which approves the Revised Text of the Intellectual Property Law, regulating, clarifying and harmonising current legislation on the matter, the reproduction, distribution and public communication, including the means by which they are made available, of all or part of the Contents, for commercial purposes, on any support and by any technical means, without the express written authorisation of REAL MADRID or a third party owner of the affected rights, is expressly prohibited.
The User agrees to respect the intellectual and industrial property rights of REAL MADRID and/or third parties.
3. Terms of use of the Website
3.1 General
The User acknowledges and accepts that access to and use of the Website is done voluntarily and consciously, under his or her sole responsibility.
The User undertakes to use the Website correctly and lawfully in accordance with the Law, this Legal Notice, good faith and public order. The User will be liable to REAL MADRID or third parties for any damage or harm that may be caused as a result of non-compliance with this obligation.
Use of the Website for purposes that harm the property or interests of REAL MADRID or third parties, or otherwise overwhelm, damage or disable networks, servers and other computer equipment (hardware) or products and applications (software) belonging to REAL MADRID or third parties, is expressly prohibited.
The following actions are also prohibited:
3.2 Contents
The User agrees to use the Contents in accordance with the Law, this Legal Notice, good faith and public order, as well as with any other conditions, regulations or instructions that may be applicable in accordance with the provisions of Clause 1.
The User shall, in accordance with current legislation and without limitation, refrain from:
a) Reproducing, copying, distributing, making available, publicly disclosing, altering or modifying the Contents, except in cases authorised by Law or, where applicable, expressly consented to by REAL MADRID in writing or by the holder of the exploitation rights.
b) Reproduce or copy for private use any Content that may be considered software or a database in accordance with current intellectual property legislation, or publicly disclose the Content or make it available to third parties, when such acts necessarily imply reproduction by the User or a third party.
c) Extract and/or reuse all or a substantial part of the Contents of the Website, or of any databases that REAL MADRID makes available to the Users.
d) Obtain or attempt to obtain the Contents by means or procedures other than those that, as the case may be, have been made available for this purpose or have been expressly indicated on the Website or, in general, those normally used on the Internet in order to avoid any risk of damage or deactivation of the Website and/or the Services.
3.3 Adding links to the website
Any Internet User wishing to insert links from their own websites to the Website must comply with the conditions set out below, and failure to comply with these conditions will not exempt them from any legal liability:
(a) The link shall only be to the home page of the Website and you may not reproduce it in any way (in-line linking, copying of text, graphics, etc.).
b) In accordance with the applicable legislation in force from time to time, it is prohibited in any case to establish frames of any kind around the Website, or to allow the Content to be viewed through URLs other than the URL of the Website and, in any case, where the Content can be viewed together with content outside the Website, in such a way that: (i) causes, or may cause, error or confusion in, or deceives or may mislead Users as to the true origin of the service or Content; (ii) constitutes an act of comparison or imitation; (iii) serves to take advantage of the reputation of the REAL MADRID brand and prestige; or (iv) is prohibited by current legislation.
c) No false, inaccurate or incorrect statement may be made about REAL MADRID, its directors, members, employees or clients, or about the quality of the services it provides, on the page where the link is inserted.
d) Under no circumstances shall it be stated on the website where the link is located that REAL MADRID has given its consent for the insertion of the link, or sponsors, collaborates, verifies or supervises the services of the website where the link appears.
e) The use of any denominative brand, figurative brand or combined brand or any other distinctive symbol of REAL MADRID in the website where the link appears is prohibited, except in the cases allowed by law or expressly authorised by REAL MADRID in writing and provided that in such cases the direct link to the Website is allowed in the manner established in this Clause.
f) The page where the link is created must faithfully comply with the law and may not, under any circumstances, have or be linked to its own or third party content that: (i) are unlawful, harmful, immoral or indecent (content that is pornographic, violent, racist, etc. ); (ii) induces or may induce the User to the false belief that REAL MADRID subscribes to, endorses, adheres to or in any way supports the ideas, representations or expressions, legal or illegal, that appear on the website where the link is located; (iii) is inappropriate or irrelevant to the activities of REAL MADRID in terms of the place, content and subject matter of the website where the link appears.
4. Disclaimer
4.1 Of information
The User accepts that REAL MADRID assumes no responsibility for the delay, deletion, erroneous delivery and/or lack of storage of the User's communications or personal configurations.
REAL MADRID is also not responsible for decisions made based on the information provided on the Website nor for damages to the User or third parties arising from actions based exclusively on information obtained from the Website.
4.2 On the quality of service
We reserve the right to refuse to provide the service to anyone for any reason and/or to discontinue the service or any part thereof, with or without notice.
The use of this website is subject to all applicable regulations and the user is solely responsible for the content of their communications on the website.
Access to the Website does not imply any obligation on the part of REAL MADRID to control the absence of viruses, worms or any other malicious software. The User is responsible in all cases for having the appropriate tools for the detection and disinfection of malicious software.
REAL MADRID is not responsible for any damage to the hardware of Users or third parties during the provision of the Website service.
REAL MADRID does not offer any guarantee and in no case is liable for damages of any kind arising from the access or use of the Website Contents. Among others, REAL MADRID shall not be liable for the following circumstances:
4.3 On service availability
Access to the Website requires services and supplies from third parties, including transmission through telecommunications networks, whose reliability, quality, continuity and functionality are not the responsibility of REAL MADRID. Consequently, the services provided through the Website may be suspended, cancelled or blocked, before or simultaneously to the provision of the Website service.
REAL MADRID is not responsible for damages of any kind caused to the User as a result of failures or disconnections in telecommunications networks, computer failures or other electronic systems that cause the suspension, cancellation or interruption of the Website service during or prior to the provision of the service.
4.4 About the contents and services linked through the Website
The Website access service includes technical linking devices, directories and even search tools that allow the User to access other websites and Internet portals (hereinafter, 'Linked Sites'). In such cases, REAL MADRID acts as an intermediary service provider in accordance with article 17 of Law 34/2002, of 12 July 2002, on Information Society Services and Electronic Commerce (the "LSSI") and shall only be responsible for the contents and services provided in the Linked Sites to the extent that REAL MADRID is aware of their unlawfulness and has not deactivated the link with due diligence. If the User considers that there is a Linked Site with illegal or inappropriate content, the User may notify REAL MADRID in accordance with the procedure and effects established in Clause 6, although such notification shall not imply, in any case, any obligation to remove the link in question.
In no case shall the existence of Linked Sites presuppose the existence of agreements with the owners or those responsible for such Linked Sites, nor recommendation, promotion or identification of REAL MADRID with the representations, contents or services provided. The Linked Sites are provided for reference purposes only.
Although REAL MADRID only provides links to websites that to the best of its knowledge and belief comply with the applicable legislation, REAL MADRID does not know or approve the contents or services of the Linked Sites and, therefore, is not liable for damages caused by the unlawfulness, quality, obsolescence, unavailability, error or ineffectiveness of the contents and/or services of the Linked Sites, or for any other damage that is not directly attributable to REAL MADRID.
We reserve the right to remove or block access to this content suspected of being illegal or harmful to the property or rights of third parties subject to compensation, including cases in which we have actual knowledge of this, whether by court decision, administrative order or any other means.
5. Reporting of illegal and inappropriate activities
If the User or any other Internet user becomes aware of Linked Sites that redirect him/her to websites whose contents or services are illegal, harmful, degrading, violent or immoral, he/she may contact REAL MADRID indicating the following:
a) Personal details of the caller: name, address, telephone number and e-mail address;
b) Description of the facts that reveal the illegal or inappropriate nature of the Linked Site;
c) In case of infringement of rights such as intellectual or industrial property rights, the personal data of the holder of the infringed right, when the holder is not the communicating party. An instrument attesting to the legitimacy of the holder of the rights and, where appropriate, the authority to act on behalf of the holder, where the holder is not the communicating party, must also be provided;
d) An express statement that the information contained in the communication is truthful.
The reception by REAL MADRID of the communication provided for in this clause shall not imply, in accordance with the provisions of the LSSI, the effective knowledge of the activities and/or contents indicated by the communicating party.
Likewise, a certificate must be provided accrediting the legitimacy of the holder of the rights and, if applicable, the power to act on behalf of the holder in the case of a person other than the communicating party, as well as an express statement that the information contained in the communication is accurate.
6. Duration and Amendment
The conditions of this Legal Notice will be in force until they are modified, and when REAL MADRID makes such modifications, they will be communicated to the User.
REAL MADRID may delete, add or modify both the Contents and the services offered, as well as the way in which they are located or presented. The terms that are in force and published when the User accesses the Website are understood to be in force. REAL MADRID invites you to periodically consult the current Legal Notice.
7. Legislation and Jurisdiction
This Legal Notice is regulated in each of its points by Spanish law for the resolution of any dispute related to this Legal Notice or the relationship between its points.
